These Terms and Conditions of Sale and Terms of Website Use shall apply to all contracts entered into with PLAX Jewellery UK Limited (“PLAX Jewellery, “we” “our” or “us”) whose registered office is at Ground Floor, 2 Woodberry Grove, London N12 0DR.

By placing your order with us, you are agreeing to these Terms and Conditions. If you do not accept these Terms and Conditions, please do not use our site.

WEBSITE TERMS AND CONDITIONS OF SALE

1. ABOUT US

1.1 We operate the website www.plaxjewellery.com

1.2 We are PLAX Jewellery UK Limited, a company registered in England and Wales at Companies House. Our registered office address is Ground Floor, 2 Woodberry Grove, London, N12 0DR.

1.3 We create exclusively ‘Made to Order’ fine Pearl jewellery. Each Product is made for you exclusively and exquisitely crafted by our team of designers and expert craftsmen.

1.4 You may contact us at this address or via email at customerservices@plaxjewellery.com or by telephone on +44 (0) 203 475 7993, Monday – Friday between 10 pm – 6 pm GMT.

2. THE CONTRACT

2.1 Upon placing your order on our site, you will receive an email acknowledging receipt of your order and payment (Order confirmation) this will be sent to the email address provided.

2.2 The Order confirmation constitutes an offer to us to buy a Product. We will send a second email to notify you of the receipt of payment, after which the production of your jewellery will commence with the estimated delivery date (as detailed on our website) relating to the Product(s) provided.

2.3 Production of your jewellery will only commence upon receipt of order and full or partial payment, as per the agreed payment terms. Our production and delivery time for exclusively made to order pieces is between 2 – 6 weeks, depending on the specific product.

2.4 Where two or more Product(s) have been ordered at the same time, the production time will run concurrently.

2.5 The contract between us will only be established upon dispatch of the Product(s). We will send a Dispatch Confirmation email, to the email address provided, only at that juncture will be the order become contractual.  This is also applicable to orders placed with us by telephone, in writing by email and other Distance Sales.

2.6 If we are unable to fulfil your order, we will send you an email to inform you that your order was not accepted and refund the payment for the Order to you.

2.7 It is your responsibility to ensure that the Product(s) purchased does not breach any rules or regulations in the country to which the Product is been shipped as we will not be liable for any delays or impoundments of Products.

2.8 Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts.

3. PRICES AND PAYMENTS

3.1 The price of the Product(s) and delivery charges will be as quoted on our site, the exception been cases of obvious error.

3.2 All prices are inclusive of VAT in the UK and EU. Prices are liable to change at any time but changes will not affect orders in respect of which we have already sent you a dispatch confirmation.

3.3 The prices of some of our products may change from time to time. If the price of a product has changed or there has been a pricing error, we will contact you upon receipt of your order before proceeding with production to inform you and seek your approval to either proceed or withdraw. Should you wish to proceed we will send you another Order confirmation with the correct price. 

3.4 It is possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. Where a product’s correct price is less than our stated price, we will charge the lower price and either refund the balance or offer you credit towards a future purchase. Where the prices are higher than the stated price, we will contact you for further instruction and thereafter either proceed with the order or reject it.

3.5 Where it is obvious that the price is an unmistakable error, we do not have to send the goods out to you at the incorrect price. We will contact you to inform you of the correct price and seek your permission to either proceed or withdraw.

3.6 Payment can be made by either credit/debit cards, Paypal or Bank Transfer. If you pay by Bank Transfer, we will confirm receipt of payment upon arrival in our bank account. Should the product be unavailable, the funds will be returned to the bank from it was sent. 

3.7 Recipient's bank charges where payment is made to us by you to our receiving bank is paid by us, all other charges including relating to a currency other than UK pounds sterling is payable by you.

3.8 We sell in Pound Sterling, any shortfalls due to currency fluctuation where payment is made in other currency other than pound sterling will be your responsibility. 

3.9 Where a partial payment is made for a Product(s), the final billing will be provided according to the current daily exchange rates.

4. DELIVERY

3.1 The price of the Product(s) and delivery charges will be as quoted on our site, the exception been cases of obvious error.

5. CONSUMER CANCELLATION RIGHTS

5.1 As our current collection is made exclusively to order, we allow 3 days for you to cancel your order, from the day the order is placed.

5.2 Once you have received the 'Order Confirmation' email and after the 3 days, we will begin the process of creating your jewellery. We allow 3 days for any orders placed to be cancelled; beginning from the day the 'Order Confirmation' email was received.

5.3 We are unable to accept cancellations of orders after the 3-day cancellation period, as the production of your order would have commenced.

5.4 To cancel an order, please inform us by writing via email within the designated cancellation period.

5.5 In the event of an order cancellation within the 3-day cancellation period, a full refund will be given. Please note that refunds may take up to 30 days to show in your account.

5.6 We will refund non-customised Product(s) purchased on our website from our collection within 14 days from the date of the receipt of the Product(s), provided the Product(s) is returned in its original packaging and condition.

6. DAMAGED OR DEFECTIVE PRODUCTS

6.1 Should an item be deemed defective or damaged upon receipt, please contact us our customer services team as soon as possible upon receipt of the Product(s) with your order reference number.

6.2 The Product will need to be returned to us, with the information provided to you by our customer services team.

6.3 Upon receipt of the damaged or defective product, we will examine the Product(s) and upon confirmation of defect or damage, we will either; repair the product as soon as possible, offer you a replacement (where possible) or refund the amount paid for the Product(s), including any costs incurred in returning the item and re-shipping to you, excluding import duties and taxes.

6.4 We regret that we are unable to refund any products that have been deemed damaged or faulty resulting from usage of the Product(s).

6.5 Any item deemed defective or damaged needs to be returned to us immediately upon receipt and within 7 days beginning the day the Product(s) was received for UK customers; for EU and international customers within 14 days from the day, the Product(s) was received.

 7. RETURNS

7.1 We create exclusively ‘Made to Order’ jewellery. Each Product is made for you exclusively and exquisitely crafted by our team of designers and expert craftsmen.

7.2 As each item on our site is made exclusively to order, we will accept returns only for non-customised Products purchased from our collection, which means Product(s) purchased as featured on our website, without any requested modifications.

7.3 We are happy to refund non-customised Products purchased on our website from our collection within 14 days, provided the Product(s) is; returned in its original packaging and original condition and there are no signs of damage or impairment attributed to the usage of the Product(s).

7.4 Upon acceptance of a returned Product(s) that meets the conditions set out in 7.2, we will process the refund for the Product(s). Please note that refunds may take up to 30 days after approval of returns upon receipt of goods.

7.5 To return an item, please contact us in the first instance at customerservices@plaxjewellery.com to obtain a Product Returns Number (PRN), which you will need to send with the Product(s). A Product Returns Number (PRN) will need to be obtained from us before returning any goods. Any returns without an PRN will be deemed invalid and not processed. You can obtain an PRN by sending a request to customerservices@plaxjewellery.com

7.6 For our UK customers, Products will need to be returned within 14 days, beginning on the day the Product(s) was received. For EU and international customers, Products will need to be returned within 21 days beginning on the day the Product(s) was received. 

7.7 We strongly recommend that you use reputable couriers with tracked and signed for delivery services, as we are unable to accept responsibility for items lost or damaged in the post.

7.8 We are not liable for any returns lost or damaged in transit.

7.9 In the event of a faulty Product(s), having been accepted by us as a manufacturing fault, we will repair, replace or refund the damaged Product(s) for you and refund any associated shipping costs, per Section 6.  

7.10 We regret that we are unable to refund customised pieces.

8. IMPORT DUTIES AND TAXES

8.1 We cannot guarantee the sale and delivery of our Product(s) to your particular country or location; it is your responsibility to check import restrictions in your geographical location.

8.2 Products ordered from us for delivery outside of the UK may be subject to import duties and taxes. You will be responsible for payment of any such import duties and taxes.

8.3 Please note that import duties charges and taxes are completely out of our control and therefore we cannot foretell their amount as they are set by each country’s customs office. Please contact your local customs office for further information.

8.4 Please also note that the liability to comply with local laws and regulations of the country the Product(s) are been delivered to rests with you; therefore we will not be liable for any breach of any such laws.

9. WARRANTY

9.1 We warrant to you that any Product(s) purchased from us will on delivery and for the following 12 months, conform in all material respects with its description, be of satisfactory quality, and be reasonably suitable for the purposes for which the Product(s) of that nature are commonly supplied.

9.2 Please note however, that due to the natural nature of Pearls, slight variations may occur with individual Products compared to those depicted on our site.

 

10. LIABILITY

10.1. If we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the terms and conditions or our negligence, but we are not responsible for the loss of damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious result of our breach or if they were contemplated by you and us at the time we entered into this Contract.

10.2 We will not be liable for losses in your business resulting from our failure to comply with these Terms and Conditions of Sale that fall into the following categories:

a) loss of income or revenue;

b) loss of business;

c) loss of profits;

d) loss of anticipated savings;

e) loss of data; or

f) waste of management or office time

10.3 We shall only be liable to you for the purchase price of the Products.

10.4 Nothing in these Terms and Conditions of sales will limit or exclude our liability for personal injury or death caused by our negligence or for fraud or fraudulent misrepresentation or any other liability that cannot be excluded by law.

 

11. WRITTEN COMMUNICATION

11. 1 Applicable laws require that some of the information we send you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by email and provide you with information by posting notices on our website.

11.2 We may give written permission to you either via the email or postal address you provided when placing an order.

11.3 For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This does not affect your statutory rights.

 

12. EVENTS OUTSIDE OUR CONTROL

12.1 We will not be liable or responsible for any breach of our obligations resulting from causes beyond our reasonable control (Force Majure Event).

12.2 A Force Majure event includes any act, circumstance, event, non-happening, omission or accident beyond our reasonable control, including (without limitation) the following:

a) flood, fire, storm, earthquake, subsidence, epidemic or other natural disasters;

b) war (whether declared or not), threats of war terrorism, terrorist attack or threat of terrorist attack, civil commotion;

c) strikes, lock-outs and other industrial action;

d) retention of products by any authority including customs;

e) the acts, decrees, legislation, regulations or restrictions of any government;

f) restrictions on the use of railways, shipping, aircraft, motor transport or other means of public or private transport;

g) disruption to communication including restrictions of public and private telecommunication networks;

h) pandemics or epidemics

 

13. WAIVER

If we fail at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these Terms and Conditions of Sale, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

 

14. SEVERABILITY

If any court or competent authority decides that any of the provisions of these Terms and Conditions or any provisions of a Contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining items, which will continue to be valid to the fullest extent permitted by law.

 

15. ENTIRE AGREEMENT

We intend to rely upon these Terms and Conditions of Sale and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding and agreement between us relating to the subject matter of any Contract.

16. LAW AND JURISDICTION

These Terms and Conditions of Sale and all Contracts of purchase of Products through our website and otherwise, and any disputes or claim arising out of or in connection with them or their subject matter or formation shall be governed by English Law and be subject to the non-exclusive jurisdiction of the courts of England and Wales.  

 

17. THIRD-PARTY RIGHTS

A person who is not a party to these Terms and Conditions of Sale or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.
